General information on data processing

Scope of the processing of personal data
As a matter of principle, we collect and use personal data of our users only insofar as this is necessary for the provision of a functional website as well as our contents and services. The collection and use of our users’ personal data regularly only takes place with the user’s consent. An exception applies in those cases in which it is not possible to obtain prior consent for actual reasons and the processing of the data is permitted by legal regulations.

Legal basis for the processing of personal data

Data deletion and storage period

  • You have the right to restrict processing if you dispute the accuracy of the personal data concerning you for a period enabling the controller to verify the accuracy of the personal data; the processing is unlawful and you object to the erasure of the personal data and request instead the restriction of the use of the personal data; the controller no longer needs the personal data for the purposes of processing but you need them for the assertion, exercise or defence of legal claims, or if you object to the processing pursuant to Art. 21 (1) DSGVO and it is not yet clear whether the legitimate reasons of the controller outweigh your reasons.
  • You can request the deletion of your data. This is possible if the legal basis for the data processing is missing or has ceased to exist. The same applies in the event that the purpose of the data processing has ceased to exist due to the passage of time or other reasons. Please note that an existing retention period or other interests of the Bavarian Red Cross worthy of protection may prevent deletion. We will be happy to inform you of this on request. If we have made your data public, we are obliged to inform each recipient that you have requested the deletion of all links to this personal data or of copies of this personal data.

Due to legal regulations, we are allowed to temporarily store the data and log files. The temporary storage of the IP address (duration of use) is necessary to deliver the website to you.

We have integrated YouTube videos into our online offer, which are stored on http://www.YouTube.com and can be played directly from our website.

By visiting the website, YouTube receives the information that you have accessed the corresponding sub-page of our website. In addition, the above-mentioned data is transmitted. This occurs regardless of whether YouTube provides a user account via which you are logged in or whether no user account exists. If you are logged in to Google, your data will be directly assigned to your account. Newsletter and broad communication

We send newsletters, e-mails and other electronic notifications (hereinafter “newsletter”) only with the consent of the recipients or a legal permission. If the contents of a newsletter are specifically described in the course of registration, they are decisive for the consent of the user. Otherwise, our newsletters contain information about our services and us.

To subscribe to our newsletters, it is generally sufficient to provide your e-mail address. However, we may ask you to provide a name for the purpose of a personal address in the newsletter, or further details if these are required for the purposes of the newsletter.

Double opt-in procedure: 

Registration for our newsletter is always carried out in a so-called double opt-in process. This means that after registration you will receive an email asking you to confirm your registration. This confirmation is necessary so that no one can register with other people’s email addresses. The registrations for the newsletter are logged in order to be able to prove the registration process in accordance with the legal requirements. This includes the storage of the registration and confirmation time as well as the IP address. Changes to your data stored with the dispatch service provider are also logged.

Erasure and restriction of processing:

We may store unsubscribed email addresses for up to three years based on our legitimate interests before deleting them in order to be able to prove consent formerly given. The processing of this data is limited to the purpose of a possible defence against claims. An individual deletion request is possible at any time, provided that the former existence of consent is confirmed at the same time. In the event of obligations to permanently observe objections, we reserve the right to store the e-mail address in a blacklist for this purpose alone.

The logging of the registration process is carried out on the basis of our legitimate interests for the purpose of proving its proper course. If we commission a service provider to send e-mails, this is done on the basis of our legitimate interests in an efficient and secure sending system.

Notes on legal bases:

Newsletters are sent on the basis of the recipients’ consent or, if consent is not required, on the basis of our legitimate interests in direct marketing, if and insofar as this is permitted by law, e.g. in the case of existing customer advertising. Insofar as we commission a service provider to send e-mails, this is done on the basis of our legitimate interests. The registration process is recorded on the basis of our legitimate interests in order to prove that it was carried out in accordance with the law.

Measuring success:

The newsletters contain a so-called “web beacon”, i.e. a pixel-sized file that is retrieved from our server when the newsletter is opened or, if we use a dispatch service provider, from their server. Within the scope of this retrieval, technical information such as information on the browser and your system, as well as your IP address and the time of the retrieval, are initially collected.

This information is used for the technical improvement of our newsletter based on the technical data or the target groups and their reading behaviour based on their retrieval locations (which can be determined with the help of the IP address) or the access times. This analysis also includes determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to the individual newsletter recipients. However, it is neither our intention nor, if used, that of the dispatch service provider to observe individual users. Rather, we use the analyses to identify the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.

The evaluation of the newsletter and the measurement of success are carried out, subject to the express consent of the user, on the basis of our legitimate interests for the purpose of using a user-friendly and secure newsletter system that serves both our business interests and the expectations of the users.

Unfortunately, a separate revocation of the performance measurement is not possible; in this case, the entire newsletter subscription must be cancelled or revoked.

  • Legal basis: Consent (Art. 6 para. 1 p. 1 lit. a DSGVO), Legitimate Interests (Art. 6 para. 1 p. 1 lit. e. DSGVO).
  • Possibility of objection (opt-out): You can cancel the receipt of our newsletter at any time, i.e. revoke your consent or object to further receipt. You will find a link for cancelling the newsletter either at the end of each newsletter or you can use one of the contact options given above, preferably e-mail, for this purpose.
